EU Data Act Now in Effect: A Milestone for Europe’s Data Economy
September 12, 2025 – The EU Data Act (Regulation (EU) 2023/2854) is now applicable across all 27 EU Member States. This landmark regulation establishes harmonised rules for the fair access to and use of data, aiming to foster innovation while ensuring security and compliance.
The Act introduces key obligations for businesses:
Data Portability – Users must be able to transfer their data between providers without barriers.
Cloud Switching – Cloud providers must enable seamless migration, preventing customer lock-in.
Secure Data Sharing – Access to data must be balanced with safeguards for trade secrets and intellectual property.
Public Sector Access – In defined cases, public authorities may request data from the private sector to address emergencies.
